State, 54 Tex. Crim. 434, 113 S.W. 280, and all other cases cited by Judge Graves in such opinion, with the possible exception of Robinson v. State, 54 Tex. Crim. 559, 113 S.W. 763 and Ex Parte Beard, 41 Tex. 234.
